TERMS OF SERVICE
OVERVIEW
This website is operated by The Orelis, ul. Bałtycka 2, 31-214 Kraków, Poland. "We", "us" and "our" refer to The Orelis. By using this site or buying from us, you agree to these Terms of Service ("Terms") and the policies linked from them.
SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms, you confirm that you are at least the age of majority in your state or territory of residence. To use the site you may be asked for information such as your email address and your billing, payment and delivery details. You confirm that the information you give us is correct, current and complete.
SECTION 2 - OUR PRODUCTS
We describe our products, including their measurements and materials, as accurately as we can. Colours may look slightly different on your screen, and natural materials such as ceramic glazes, wood grain and stone vary from piece to piece. If an item is not as described, see our Refund Policy.
SECTION 3 - ORDERS
Your order is accepted when we send you an order confirmation. We may refuse or cancel an order only if the product is unavailable, the price or description was clearly wrong, we cannot deliver to your address, or we reasonably suspect fraud. If we cancel, we will tell you and refund everything you paid within 5 business days. Our products are sold for personal use.
SECTION 4 - PRICES AND BILLING
We may change prices or products at any time, but changes never affect an order we have already accepted. You agree to provide accurate and current purchase and account information.
Prices are in Australian dollars (AUD). Delivery to Australia is free, with no minimum spend and no extra fees at checkout. Duties and taxes for orders over A$1,000 are described in our Shipping Policy.
SECTION 5 - SHIPPING AND DELIVERY
Delivery times are estimates. We are not responsible for delays caused by carriers or customs. Title and risk pass to you once we hand the products to the carrier.
SECTION 6 - INTELLECTUAL PROPERTY
The site and its content, including text, images, graphics and video, belong to The Orelis and are protected by copyright and other intellectual property laws. You may use the site for personal, non-commercial purposes only.
SECTION 7 - OPTIONAL TOOLS
We may give you access to third-party tools that we do not monitor or control. You use them at your own risk.
SECTION 8 - THIRD-PARTY LINKS
The site may link to websites run by third parties. We are not responsible for their content or accuracy.
SECTION 9 - RELATIONSHIP WITH SHOPIFY
The Orelis runs on Shopify. Purchases are made directly with The Orelis, and Shopify is not responsible for sales between you and us.
SECTION 10 - PRIVACY POLICY
Personal information you submit through the store is handled under our Privacy Policy.
SECTION 11 - FEEDBACK
If you send us ideas, reviews or other content, you give us a worldwide, perpetual licence to use and display it in any medium.
SECTION 12 - ERRORS AND OMISSIONS
The site may occasionally contain typing errors or omissions in product descriptions, prices or availability. We may correct them at any time.
SECTION 13 - PROHIBITED USES
You may not use the site or its content for any unlawful purpose or to encourage others to act unlawfully.
SECTION 14 - AUTOMATED TOOLS
Software agents and AI tools may use the site only if they identify themselves truthfully.
SECTION 15 - TERMINATION
We may end this agreement or your access to the site at any time. Ending it does not affect orders already accepted or your rights in relation to them.
SECTION 16 - CONSUMER GUARANTEES
Our products come with guarantees that cannot be excluded under the Australian Consumer Law (see our Refund Policy). Nothing in these Terms excludes, restricts or changes any right or remedy you have under that law or any other law that cannot be excluded.
SECTION 17 - LIMITATION OF LIABILITY
Subject to Section 16 and your other legal rights, we are not liable for loss that was not reasonably foreseeable, or that is caused by misuse of a product or by events outside our reasonable control.
SECTION 18 - SEVERABILITY
If any part of these Terms is found to be unlawful or void, it will still apply as far as the law allows, and the rest of the Terms remain in effect.
SECTION 19 - WAIVER AND ENTIRE AGREEMENT
If we don't enforce a right under these Terms, we have not waived it. These Terms and the policies they link to are the entire agreement between you and us.
SECTION 20 - ASSIGNMENT
You may not transfer this agreement without our written consent. We may transfer it to another business only if your rights are not reduced.
SECTION 21 - GOVERNING LAW
These Terms are governed by the laws of Poland. If you are a consumer in Australia, you keep the protection of the consumer laws where you live.
SECTION 22 - HEADINGS
Headings are for convenience only.
SECTION 23 - CHANGES TO THESE TERMS
We may update these Terms by publishing a new version on this site. The version published when you place an order applies to that order.
SECTION 24 - RETURNS
You can return an item within 30 days of delivery, for any reason. Please email support@theorelis.com before sending anything. Full details, including return postage, are in our Refund Policy.
SECTION 25 - DAMAGED OR FAULTY ITEMS
If an item arrives damaged, faulty or different from your order, email support@theorelis.com with your order number and a few photos, and we'll arrange a replacement or refund as described in our Refund Policy.
